During portion of that time, he learned afterwards, his wife had lived with a man named John Jones, and had given birth to a child.

Mr. B. Murphy (instructed by Mr. E. L. J. Murphy, for Mr. P. R. Fraser, of Geelong), who appeared for petitioner, said that Jones, who was to have beenjoined as co-respondent in the suit, had died before the petition could be issued. He asked that in the circumstances he be excused from naming a co-respondent in the suit.
