In The Name of God Amen
I Samuel Dearnly of Newton in the Parish
of Mottram and County of Chester, Dyer,
Do this Seventeenth Day of April, in the year
of our Lord One Thousand Eight Hundred
and Twenty Eight. Being weak in Body, but
of a sound and perfect disposing Mind,
Memory and Understanding, Praised be
Almighty God for the same. Do make
this my last Will and Testament in
manner following. First it is my
will and mind that all my Just debts
owing by me at my decease, the Funeral
expenses, the Probate and Execution of
this my last Will and Testament, be duly
paid out of my Cash at my decease
by my Executors herein after named,
to whom I commit the conduct and ordering
the Solemnity of my Funeral Rites, and
I will that they Amply pay themselves
for their trouble and time bestowed thereupon.


Secondly. I have a Legacy left me by Will of
my Uncle Samuel Dearnley late of Cross Cliff,
in the Parish of Glossop in the County of
Derby, be the same little or much, It is my
will and desire that the said Legacy be equally
divided among my Children and my Lawful
loving Wife Martha Dearnley Share and Share
alike, namely to John Dearnley my Son,
Jonas Dearnley my Son, Ellen my Daughter
deceased, but her share to be equally divided
among her Children, Jane my Daughter
deceased, but her share to be equally divided
among her Children, and Mary my Daughter
the wife of William Lomas, (with particular
instructions further mentioned in this
Testament) and Martha my said Lawful Wife,
I say equally divide Share and Share alike.


Thirdly. It is my will and mind, that
the shares of my two Daughters Ellen and Jane
deceased, their Children being young and under
the age of Twenty One years, the said shares
in money shall be put out to Interest upon
good and sufficient Security and the interest
arising from the Shares in money, shall be
paid towards their bringing up and Education
untill the time that they attain respectively the
Age of twenty One years, at which time and age
they shall receive their respective shares, and in
case any of the said Children die before the
said age of twenty One years, such deceased
Child's share shall be divided equally among
the Survivors.


Fourthly. It is my will and desire that all
my Household Furniture, Beds and Beding and
every other Utensil thereunto belonging [?]i That
my Lawful Wife Martha Dearnley Holds, Keeps
and enjoys the same during her natural Life.


Fifthly. It is my will and mind, that
my said Wife shall have full power to
give or dispose of the aforesaid Household
Furniture at her decease as she shall
think proper.

And I do hereby constitute and appoint
my son John Dearnley and Jonas Dearnley my
Son Joint executors of this my last Will
and Testament, In witness whereof I have
hereunto set my Hand and Seal, this Seventeenth
Day of April, in the year One Thousand Eight-
Hundred and Twenty Eight.
