1 In the name of God amen I Joseph Dearneley of Nether Stubbin in the
2 hamlet of Austonley within the parish of Almondbury and county of York yeoman being weak in body but of sound
3 mind and perfect memory (praised be almighty God for the same) do constitute make and ordain this my last will
4 and testament in manner and form following. Having first surrendred and given up with a straw into the hands of the
5 Lord of the Manor of Wakefield according to the custom thereof all those two my copyhold messuages or tenements situate
6 lying and being at Callwell and Nether Stubbin with all and singular their appurtenances to such use and uses intents
7 limitations and purposes as is are or shall be mentioned in and by my last will and testament. And I do declare the
8 uses thereof to be these herein after mentioned. First I give to my loving wife one half of the houshold goods where we
9 now dwell the other half I give to my executor herein after named, also I give her the said house for an habitation
10 during the term of her natural life if she chuses to dwell therein. Also I give and devise unto William Dearneley
11 my son all that my messuage or tenement situate standing lying and being at Callwell with all and singular its appurtenan
12 -ces untill Joseph Dearneley his son shall attain to the age of twenty and one years. And then I give and devise the said messuage
13 lands and tenement at Callwell aforesaid with all and singular the appurtenances unto him the said Joseph Dearneley and to his
14 heirs for ever, he paying out of the same yearly and every year unto him the said William Dearneley his father the sum of
15 five pounds during the term of his natural life and further charged with the sum of one hundred pounds which I do will
16 order and appoint to be paid out of the same to the rest of the children of William Dearneley my son which shall be
17 alive and at the age of twenty and one years to receive their shares thereof when he the said Joseph shall
18 arrive at the age of twenty and four years and if any of them shall be then under the age of twenty and one
19 years or shall happen to dye before their legacies become due and leave issue, then it is my will and
20 mind that such as are then under age and likewise the issue of such as be dead before their legacies be due
21 shall be and are hereby entitled to their equal shares of the above given hundred pounds when they shall
22 attain to their respective ages of twenty and one years. And if he the said Joseph dye before he shall attain
23 to the age of twenty and one years then I give and devise the abovesaid messuage or tenement at Callwell
24 with the appurtenances unto John Dearnley the younger son of the same William Dearneley and to his heirs
25 for ever, subject to and charged with the payment of the yearly sum of five pounds and the sum of one hundred
26 pounds as above herein expressed. Also I give and devise unto William Dearneley my son and to his heirs for
27 ever all that my messuage lands or tenement situate standing lying and being at Nether Stubbin with all
28 and singular the appurtenances he paying and discharging out of the same all my just debts funeral expences
29 legacies and annuity herein after given. First to Hannah now wife of John Knowles ... the sum of five
30 pounds and to George and William Sykes my grandsons ten pounds a piece to be paid to them in manner following
31 to Hannah at the end of two years next after my decease to George when he shall attain to the age of
32 twenty and one years and to William when he shall attaIn to the age of twenty and four years. Also the
33 annuity or yearly payment of three pounds a year unto Elisabeth Sykes my daughter during the
34 term of her natural life to be paid to her by four quarterly payments the first payment to be made
35 immediately after my decease and the receipt of her the said Elisabeth to be a sufficient discharge to my
36 executor for into her hands I order the money to be paid and not into the hands of her husband. And lastly
37 I nominate constitute and appoint William Dearneley my son sole executor of this my last will and
38 testament revoking and making null and void all former and other wills by me heretofore made. In
39 witness whereof I have hereunto set my hand and seal this fifth day of september in the year
40 of our Lord one thousand seven hundred fifty and nine
