and testament in manner & form & following that is to
say ffirrst and principally I commet my Soul into ye Hand
of allmighty God and my Body I Commit to ye Earth from
whenst was taken to be Decently intered at ye Discretion
of my Executor here affter named and Touching what I have
I Dispose of as follows-------------------------
Impri my will and mind is that my due Debts to Gather with
ffunerall Expenses be paid first out of my personall

1766 Will of Joseph Dearnaly

In the Name of God Amen I Joseph Dearnaly of Deepclough
in the parrish of Glossop & county of Derby weaver being aged but of
sound memory & perfect understanding praised be God for it do make
and ordain this my last will and testament in manner & form following
First I order my just debts funeral expenses & charges of the
probate of this my last will to be first paid & discharged out of my
personal estate & as to my burial I refer the same to the prudence
& discretion of my executor hereafter named & do recomend my
soul into the hand of God who gave it & as to such worldly estate as
the Almighty has been pleased to bestow upon me I dispose therefore
as follows Item I give unto my dearly beloved wife Sarah Dearnaly
five shillings & I likewise give her liberty to dwell & remain in my
house at Deepclough dureing the term of my lease if she so long live
or keep her self unmarried but if she should marry again it is my
mind that she shall quit the place peaceably & quietly at the time
of her marriage And further as we made a marriage covenant
between us before our marriage it is my mind & I do hereby order my
executor to take care to fullfill the same according to the ful intent
& meaning of the same & likewise any goods that she has brought
to my house at Deepclough that was hers before our marriage I
freely give her liberty to take & dispose of as she shall see proper
Item I give & bequeath unto my grandson John Ervin all my
tenament which I hold by lease under his Grace the Duck of
Norfolk both housing & land dureing the term of my lease
him alowing my wife liberty to dwell in some part of my house
as I have herebefore mentioned but it is further my mind that if my
grandson John Ervin will not occupy the (aforesaid) tenement himself but
either offers to let or sell the same that he shall peaceably & quietly
resign up the same & only have one shilling And I do hereby give
the aforesaid tenement to my grandson William Wood I likewise
give unto that person that keeps my tenement in possession one
large chist standing in the parlour that was my fathers Item I
give unto my grandson John Ervin all my wearing aparrel both
linen & woollen And then after all my just debts funeral expenses
& charges of the probate are all paid & fully discharged I then
give unto my three daughters Sarah Ervin Mary Bowers & Martha
Plat
all my money goods cattle & chattles whatsoever & wheresoever
the are to be found equaly to be devided amongst them but if any of my
daughters should die before the receive the same it is my mind that
there share shall go to there child or children And further it is my mind
that if any one that I have herein given anything do offer to make
any disturbance or seem to be uneasy at what I have done as concerning this
my will of offer to put my executor to any unncesesary trouble in the
performance of this my will I then order my executor to give him or
her one shilling only & the shall loose there legacy
& lastly I do nominate constitute & appoint my grandson John Ervin
to be my sole executor of this my last will and testament & I do revoke
disannal & make voide all other will or wills heretofore by me made
& do publish this to be my last will in witness whereof I have here
unto set my hand and seal this seventh day of February in the year
of our Lord 1766
