A MIDWIFE CHARGED WITH MURDER
On Saturday evening, Mr. R. Docker, the coroner of East Worcestershire, resumed the inquiry at the Britannia Inn, Sherbourne Road, into the circumstances attending the death of Elizabeth Darnley (33), of River Street, who died on the 3rd inst.
- Mr Daly (instructed by Mr F. Perry) attended to watch the case on behalf of the accused, who on the previous day was charged before the magistrates with using instruments upon the deceased for the purpose of procuring abortion.
- The husband of the deceased said that his wife was taken ill on the 19th of October, when she had been pregnant four months. On former occasions she had intimated that she should like to get out of her trouble. In the evening of the 2nd instant she was perfectly conscious, and knew that death was approaching: and witness, after questioning her for some time, learnt from her that Mrs Kay had given her some pills, and had also used instruments.
He fetched Mr. Mitchell to her on the 31st October. She was prematurely confined on the Monday before she died. - Harriet Lewis, wife of Elijah Lewis, Balsall Heath Road, said she had been a neighbour of the deceased, and about a month ago she accompanied the deceased to the corner of Clevedon Road, where Mrs Kay lived. Witness was with the deceased before she died, and heard her statements concerning Mrs. Kay.
- Annie Stretton, sister of the deceased said she was in her sister's bed room on the 2nd inst. and heard her reply "Yes" to questions as to whether it was Mrs Kay who had given her pills and used instruments. The deceased told witness that "the lady" hurt her very much.
- Mr A Mitchell, surgeon, Balsall Heath Road, said he found the deceased suffering from peritonitis. She had had a miscarriage. As she was in a dangerous condition he ordered a magistrate to be sent for, and was present when the deceased's dying depositions were taken.
- Mr J.W.Moore, surgeon, Moseley Road, said he made a post-mortem examination of the body on the 5th inst. The deceased died from peritonitis, brought about through inflammation of the womb. He discovered wounds which had been caused by some instrument.
- Police sergeant Pugh repeated the evidence he gave before the magistrate on the previous day. In answer to Mr Daly, the witness said he did not find any pills at Mrs Kay's house, nor anything the least suspicious. He did not produce the warrant till after he had questioned Mrs Kay.
- Mr Daly: Can you give any explanation to impress the jury with a sense of your fairness, why you, knowing you were bound to arrest her, having a warrant in your pocket - why you had not the candour and honesty, as an honest man, to come forward and say to her, "I have come to arrest you on that warrant?" Instead of which you begin to
inveigle and question her, and entrap her.
- Witness: I did what I considered right.
- Is that your usual practice? Yes, when I consider it is right.
- Do you mean to say that you have gone with a warrant in your pocket, knowing you were bound to arrest a person, and then put a lot of searching questions to him? I have.
-The Coroner : Well, I don't think you are justified in doing it; that is all.
- Mr Gibson, chemist, at his own request, gave a description of pills he had supplied to Mrs Kay, and other midwives.
- The Coroner, in summing up, explained the law on the case, and said that the evidence connecting Mrs. Kay with the case was that she admitted to the police officer.
- The Jury, after about an hour and a half's consultation, returned a verdict that the deceased died from injuries inflicted by the use of instruments by Mrs. Kay to procure abortion.
-The Coroner: Then that is a verdict of murder against Mrs. Kay.

Your letter with letters (Lithos?) enclosed rec'd (received) some days ago but (I) have been moving around a little, having made about 1600 miles of railroad since I left Ogden (?), and have never been sure just where I may be headed for, have waited till now.
Glad to find you are all O.K. as for the work you take that work stuff too seriously.
Since I left California, last May I've worked for a Master (?) 13 days, the rest of the time have been working for myself and my fellow slaves, and have managed to live. Work isn't the object of life- "Consider ye the lillies, they sow not nor gather into barns etc."
Think more of living and less of working old Sis.
Am not exactly settled in my address yet so am writing only to let you know that I got your letters. Say - I plumb forgot to send you the picture of Brigham Young Statue, didn't I?
It wasn't oranges they used, it was two pigs bladders distended. (??) Get me?
I stayed in the Salt Lake City a week since I wrote you last. Am going to try my hand as Editor of our paper soon and if I make good will send you a copy weekly.
Will write again giving you my address as soon as I get one but if I'm too slow about it you can write to one given above. Will answer Letty's (Leticia R Darnley - daughter of William Stretton Darnley and Maria Rosina Pulley ( 'Rose' of this letter)) epistle separately , young ladies don't like their parent's to get their mail first.
