Will:
John Dearnaley left a will on 1 December 1842.
  
Thomas Dearnaley of Tintwistle, Land Agent (brother) & Sarah Dearnaley of Whitfield widow, were the executors.

At the very start of John Dearnaley's will in a very simple statement he leaves a small sum of money to his grand-daughter Mary Hurst, the daughter of William Hurst, currently somewhere in America, payable when she reaches 25.
This caused executor brother Thomas and the taxman some problems, as she could not be found - a note in 1858 says 'Legacy not yet claimed. MH must be 21 [did he mean 25?] if living'. Thomas had told the taxman in 1858 'Mary Hurst went to America with her father 10 [? did he mean at least 10?] years ago, not since heard of'. Meanwhile the duty on her legacy could of course not be extorted.
'1860 Widow still living. Legacy not yet claimed'. Then in 1868 'Widow still living'.
Mary was apparently finally found (but no info as to where she was or under what name), because the duty was paid - in 1860.
'At'd 25 about 1854' (surely means 1851?).
The IR26 record is finally and probably thankfully annotated at closure of the trusts: 'Widow died 9 May 1869'; 'Catherine d 1903 - July 18 1903'.
