In the name of God amen I Joseph Dearnaley of Tintwistle in the Parish of Mottram in Longdendale and County of Chester (being of sound Desposing mind and Memory Blessed be God for the same) Do make Publish and Declare this my last Will and Testament in Manner and form following
Now therefore my will and mind is that all my just Debts, Funeral expenses and the Probate of this my last Will and Testament be paid out of my Personal estate and Effects. Next I give into the hands of my Executors hereafter named all that my real estate and effects which I am now possessed of whatsoever or wheresoever the same may be found at the time of my Death for the purposes hereafter mentioned. And I also give and bequeath to my Beloved Wife Sarah Dearnaley the Interest of all my Property which I am possessed of at the time of my Death and so much of the Principle as shall be needful for her and two children that are minors (if it should so happen to take all the Principle). But if my said wife Sarah Dearnaley is Married again then in her second Marriage she shall receive no more than the interest of the Principle which is remaining at the time of her second Marriage, and if she should be left Widow after the time of her second Marriage then to receive the Principle and Interest as Necessity requires it. And if there be any residue or remaining part of the before bequeathed property left at the Death of my said Wife now Sarah Dearnaley. I therefore give and bequeath the remaining part thereof (if any there be) to my Sons and Daughters as is herehafter specified that is to say to be Divided as far as five pounds a piece if so much there be to the after named Children John Dearnaley, William Dearnaley, James Dearnaley, Betty Dearnaley, David Dearnaley, Jessey Newton Dearnaley, Ruth Dearnaley, Abel Dearnaley, & Isaac Dearnaley, and if there be any remainder of my Property after what is Bequeathed then I give and Devise all the rest or remainder to my said Children before mentioned together with my son Joseph Dearnaley, to have and receive every one their respective shares or their hirs Executors and Asigns for them of the remaining Part if any there be.
If any of the above named children which are under the age of Twenty one years die and have no issue their respective shares shall be divided amongst the remaining children which shall then be alive. Lastly I make and ordain My son John Dearnaley and George Hyde_________ Executors of this my last Will and Testament.
